Terms of service

These terms are an agreement between you and Xianthus Software PLT. They apply when you download, install, access, or use Expensed. By doing so, you agree to them.

If anything is unclear, contact us using the details at the end.

1. Who these terms are with

Xianthus Software PLT publishes Expensed. It is a limited liability partnership registered in Malaysia under number 202604001652 (LLP0046891-LGN).

"We", "us", and "our" mean Xianthus Software PLT.

"You" means the person using the app. It also means a business or organisation if that person accepts these terms for it.

2. Who can use Expensed

You must be at least 13 years old to use Expensed.

If you are not a legal adult in your country, a parent or legal guardian must accept these terms for you and be involved in your use of the app. You must also meet the minimum age for an account with the app store you use.

Expensed helps people manage their own expense records. It is not made for children or listed in a children's category.

If you use Expensed for a business or organisation, you confirm that you have authority to accept these terms on its behalf.

3. Your licence to use the app

We give you a limited, non-exclusive, non-transferable licence to install and use Expensed on devices you own or control. You may use it for your own expense tracking or for a business or organisation you are allowed to represent.

Family sharing and similar app store rules also apply when relevant.

Expensed, its software, design, and content belong to us or their licensors. These terms let you use the app. They do not give you ownership of it.

4. Reviewing extracted information

Expensed can use text recognition and AI on your device to draft transaction details from receipts.

Receipt details and categories may be wrong or incomplete. Check them before saving.

You are responsible for checking saved transactions before relying on them. This includes merchants, amounts, dates, categories, accounts, and currency conversions.

5. Local AI limitations

Expensed AI runs on your device and depends on its hardware and available resources. It uses Gemini Nano on Android, Apple's on-device Foundation Model on iOS, or a model you download through Expensed. Apple and Google decide which devices support their built-in models.

Quality and speed vary by device, AI option, and receipt. Results may be wrong, incomplete, or unavailable. AI features only work when your device has a compatible model.

Apple or Google supplies built-in AI under its own terms. Availability may change based on your device, operating system version, and settings. We do not control or guarantee it.

Downloading an AI model uses your internet connection and device storage. The model has its own licence, which is available in the app.

Ask Emma uses the same AI and the information stored in Expensed on your device. Its answers may be wrong, incomplete, or misleading. Check important information instead of relying only on an AI answer.

6. Exchange rates

Expensed may convert currencies using rates included with the app or from an outside exchange rate provider.

Exchange rates are estimates. They may be late, incomplete, or different from the rate used by your bank, card issuer, payment provider, or currency exchange service.

Do not treat a converted amount as the exact amount charged or received. We do not control the rate provider or take responsibility for the accuracy or availability of its data.

7. Not financial or tax advice

Expensed is an expense tracking tool.

Expensed does not provide financial, tax, accounting, investment, or legal advice. This includes charts, statistics, summaries, projections, budgets, alerts, split calculations, settlement suggestions, currency conversions, and Ask Emma answers.

Check Expensed information against your receipts, invoices, statements, and other records before using it for an important purpose. This includes tax filings, reimbursement claims, financial decisions, and legal requirements. Ask a qualified professional when needed.

8. Splits and groups

Expensed lets you split an expense between people and track who owes what. You can put related splits in a group.

Expensed does not move money. It is not a payment service, money transmitter, lender, or debt collection service. It does not hold, transfer, or process funds. A split does not create, confirm, or decide a legally binding obligation. Marking a split or payment as settled only updates your records. It does not make or confirm a payment. All payments happen outside Expensed.

Expensed calculates splits, rounding, and suggested payments from the information you enter. Check them before paying someone or asking for money.

You are responsible for information you enter about other people and anything you share from the app. This includes settlement summaries. Only share suitable information with the right people.

We are not part of any agreement between you and the people in a split. We are not responsible for disputes, unpaid amounts, or how someone uses a summary you share.

9. Budgets and alerts

Budgets are limits you set for yourself. They only count transactions recorded in Expensed. Expensed converts currencies when needed using the rates in Section 6. A budget only reflects what you record in the app.

Your device creates budget notifications. They may be late, repeated, or missing. This can happen if notifications are off, background activity is limited, focus or do not disturb mode is on, your device is off, or you record an expense later.

Do not rely only on budget alerts to prevent overspending, going over a credit limit, or missing a payment.

10. Your data and backups

Your device stores your transactions, receipts, accounts, categories, tags, budgets, splits, groups, settings, and other financial records.

We do not store these records on our servers or receive a copy. We cannot access, restore, or recover them for you.

You choose the location for manual backup files. When you buy premium and turn on scheduled backup, Expensed saves backups to your own account:

  • iCloud Drive on iOS; or
  • the Google Drive app data folder on Android.

Apple or Google provides this storage. We do not run it. Apple's or Google's terms apply.

You are responsible for keeping backups. If you lose your local data and have no working backup, the data may be gone for good. We do not have another copy.

11. Paid features

Core expense tracking is free.

A one-time purchase unlocks scheduled cloud backup on the platform used to buy it. It is not a subscription and does not renew.

A purchase does not guarantee that Expensed or a feature will always be available. Section 12 explains changes to the app and paid features.

Apple processes App Store purchases, and Google processes Google Play purchases. Each store's terms apply. A purchase is tied to the store, platform, and account used to buy it.

An iOS purchase does not unlock premium on Android. An Android purchase does not unlock it on iOS.

Store refund policies apply. Ask Apple for most App Store refunds. For a Google Play purchase, Google may handle the refund. We may also handle it through Google Play when that option is available.

This section does not limit your legal rights to a refund, withdrawal, conformity, or other consumer rights.

12. Changes to the app

We may add, change, replace, or remove features. We may also stop developing or distributing Expensed.

If we remove a paid feature without a similar replacement, we will give reasonable notice in the app or on our website when reasonably possible. This gives you time to back up or export your records before the change.

Consumer law and the store's policies determine any refund or other remedy for a removed paid feature.

Removing a feature does not delete records or backups already on your device or in cloud storage. You may need a supported device and compatible app version to read or restore an Expensed backup. Export important records in a common format before you stop using the app.

We do not guarantee that Expensed will work with every future device or version of iOS or Android. We will try to maintain compatibility when reasonably possible.

13. App Store and Google Play terms

The terms of the store used to download Expensed also apply.

If you downloaded Expensed from the App Store, Apple's Standard Licensed Application End User License Agreement and Apple Media Services terms also apply.

If you downloaded Expensed from Google Play, Google Play terms also apply.

These terms add to the store terms. If they conflict, the store terms control that part.

You must follow other agreements that apply to your device, internet connection, Apple or Google account, and cloud storage.

14. Support

Xianthus Software PLT provides email support on a reasonable-efforts basis at [email protected].

We do not guarantee a response time or that we can solve every issue. Premium does not include a separate support or service-level promise.

Apple and Google do not provide support for Expensed.

15. Acceptable use

You must not:

  • use Expensed for an unlawful purpose;
  • bypass or interfere with purchase, licence, privacy, or security controls;
  • introduce malicious code or deliberately interfere with the app's operation;
  • use the app in a way that infringes another person's rights;
  • resell, sublicense, redistribute, or commercially exploit the app without our permission; or
  • reverse engineer, decompile, or attempt to extract the app's source code.

These restrictions do not apply when the law or an open-source licence clearly allows the activity despite these terms.

16. Intellectual property

Copyright, trade mark, and other laws protect Expensed, including its name, software, design, branding, interface, and original content.

These terms do not give you ownership of our intellectual property. You may only use our trade marks and branding as needed to use the app normally.

Outside software, AI models, and other components have their own licences. You can find them in the app's About or open-source licences section.

17. Privacy

Our Privacy Policy explains:

  • what information Expensed stores on your device;
  • when the app connects to the internet;
  • what we may receive when you contact support or send diagnostics; and
  • how purchases and optional cloud backups are handled.

The Privacy Policy forms part of these terms.

18. Warranty disclaimer

To the maximum extent allowed by law, Expensed is provided "as is" and "as available" without express, implied, or statutory warranties.

This includes implied warranties of merchantability, satisfactory quality, fitness for a particular purpose, accuracy, availability, and non-infringement.

We do not warrant that:

  • the app will always be available, uninterrupted, secure, or free of errors;
  • all defects or compatibility issues will be corrected;
  • receipt scanning, categories, automatic transaction details, AI answers, or currency conversions will be accurate;
  • backups will always complete successfully or remain restorable;
  • budget alerts or other notifications will arrive, arrive on time, or arrive only once; or
  • the app will meet every particular requirement or intended use.

These terms do not limit rights or guarantees that the law does not allow us to limit. This includes rights under the Malaysian Consumer Protection Act 1999 and mandatory consumer laws in your country.

19. Limitation of liability

To the maximum extent allowed by law, Xianthus Software PLT is not liable for indirect, incidental, special, exemplary, or consequential loss caused by using or being unable to use Expensed.

This includes lost data, profits, revenue, savings, goodwill, business opportunities, or business interruption, even if we knew the loss was possible.

When the law does not allow us to exclude liability, our total liability for Expensed is limited to the greater of:

  • the total amount you paid for Expensed and its paid features; or
  • USD 50.

Nothing in these terms excludes or limits liability for:

  • death or personal injury caused by negligence;
  • fraud or fraudulent misrepresentation;
  • wilful misconduct;
  • any liability that cannot lawfully be excluded or limited; or
  • your non-excludable rights as a consumer.

20. Termination

You may stop using Expensed at any time by uninstalling it.

Uninstalling the app normally removes its local data. It may not remove device backups, cloud backups, exports, or other copies. You are responsible for deleting those copies separately.

We may end your rights under these terms if you commit a material breach, meaning a serious breach. If the store provides a suitable option, we may also restrict further access to or distribution of the app.

If we end your rights because of a material breach, you will not receive a refund unless the law requires one.

Sections 16, 18, 19, 20, 22, and 23 still apply after termination. Other terms that must continue by their nature also remain in effect.

21. Changes to these terms

We may update these terms.

We will post the new terms here with a new effective date. We will give at least 14 days' notice in the app or on this page before a major change. We may give less notice when needed for legal, regulatory, security, or fraud prevention reasons.

We will not apply a major change retroactively to take away a paid entitlement you already bought. Section 12 and your consumer rights still apply to paid features.

If you keep using Expensed after new terms take effect, you accept them. If the law requires clear consent to a change, it only applies after you agree to it.

If you do not agree to the new terms, stop using and uninstall Expensed.

22. Governing law and disputes

The laws of Malaysia govern these terms, except its rules about conflicts between laws.

The courts of Malaysia can hear disputes about these terms or Expensed, but other courts may also have authority.

If you are a consumer living outside Malaysia, you keep the mandatory consumer rights provided by your local laws. You also keep any local right to bring legal proceedings in your country.

Before starting formal proceedings, contact us at [email protected] and provide a reasonable chance to resolve the issue. Either party may still seek urgent relief or use a consumer tribunal, regulator, or dispute process allowed by law.

23. General

If a part of these terms is unlawful or cannot be enforced, it will be limited as little as possible to make it enforceable. If that is not possible, that part will be removed. The rest will still apply.

If we delay or fail to enforce a term, we do not give up that term or any other right.

You cannot transfer your rights under these terms without getting our written permission first.

We may transfer these terms to a successor during a restructuring, merger, acquisition, business transfer, or sale of related assets, subject to the law.

These terms and the Privacy Policy are the full agreement between you and us about Expensed. The store terms and licences in Section 13 also apply. Together, they replace earlier agreements about the same matters.
